DOG BITES AND ANIMAL ATTACKS

Injuries Arising from Attacks and Dog Owner Negligence

Dog bites are a common occurrence, but their regularity does not minimize the pain and suffering experienced by the victim. Common injuries include puncture marks, ripping and tearing of the skin, severe scarring, permanent disfigurement, as well as pain and suffering. Often, these physical injuries require reparative or reconstructive surgery or laser treatments to heal fully.

If you have received injuries as a result of dog bites or animal attacks, you need to take action right away.  No two dog attacks are the same, and the complexities of a specific case can make it confusing for those involved. For this reason, you should consider seeking out the advice of a personal injury lawyer focused on dog bite claims.

WHAT TO DO AFTER A DOG BITE

  1. If possible, immediately identify the dog’s owner and witnesses. Obtain their addresses and phone numbers. Request proof of the dog’s rabies vaccination.
  2. Take photos of your injuries before treatment and throughout the healing process.
  3. Keep and do not wash any clothing you were wearing during the attack.
  4. Consult a doctor for medical care and documentation of your dog bite.
  5. Write down everything you can remember about the incident, taking note of the location, who appeared to be in control of the animal, and what you did immediately before and after the attack.
  6. File a report with the animal control authorities in your area.
  7. Gather and store copies of medical bills and any dog bite-related expenses you have incurred.

In Illinois, you do not have to establish that the dog owner knew or should have known the dog had a dangerous disposition. Instead, Illinois law provides strict liability under the Animal Control Act.

“If a dog or other animal, without provocation, attacks, attempts to attack, or injures any person who is peaceably conducting himself or herself in any place where he or she may lawfully be, the owner of such dog or other animal is liable in civil damages to such person for the full amount of the injury proximately caused thereby.”

510 ILCS 5/16.

This means the animal owners are personally liable to other parties for the damages these animals cause to the injured party. It does not matter whether or not the bite comes from a small or large dog breed, as any size dog can cause serious injuries.

To establish the right to recover damages, you must prove:

  • The dog attacked, attempted to attack, or otherwise injured you.
  • You had a lawful right to be in the place where the incident occurred.
  • You did not provoke the dog.

ANOTHER DOG ATTACKED YOUR DOG

In Illinois, when a dog causes injury to another dog, the negligent owner is liable for the dog’s injuries and any other resulting damages. This includes reimbursement for vet bills, medications, kennel fees, and related expenses.

If your dog dies because of the attack, compensation may include the original cost of purchasing the dog, as well as veterinarian expenses if your dog had to be euthanized.
